How Does a 30-Year Land Lease Work in Thailand?

A 30-year land lease in Thailand is one of the most common options for foreigners who want to use land for a house, villa or investment.

Since foreigners generally cannot own land directly in Thailand, a long-term lease can provide a legal right to use the land without owning it.

But an important point is: a lease is not the same as ownership.

What Is a 30-Year Land Lease?

A 30-year lease gives you the legal right to use land owned by someone else for an agreed period.

For leases longer than three years, registration with the Land Office is important. A registered lease can generally be made for a maximum of 30 years at a time.

The land remains owned by the landlord, while you have the right to use it according to the lease agreement.

Can Foreigners Build a Villa on Leased Land?

Yes, a foreigner may be able to own or construct a building on leased land, depending on how the transaction is structured.

For example, you may lease the land while having separate rights to the villa or house built on it.

The lease should clearly explain:

  • Who owns the building
  • Who has the right to build
  • What happens to the building when the lease ends
  • Whether the property can be transferred or sold

This is especially important when buying a villa in Koh Phangan or Koh Samui.

What Happens After 30 Years?

This is one of the most important questions.

A 30-year lease does not automatically become a 60- or 90-year lease.

The parties may agree on renewal arrangements, but a future renewal should not be treated as guaranteed ownership.

If you see a property advertised as “30 + 30 + 30 years,” you should have the actual legal structure and contract reviewed before making any payment.

What Should You Check Before Signing?

Before paying a deposit, check:

  • Land title and ownership
  • Any mortgages or encumbrances
  • Legal access to the property
  • Building and construction status
  • Lease term and registration
  • Renewal and termination clauses
  • Transfer and inheritance rights
  • Ownership of the building

A low-priced leasehold property can become expensive if these issues are not checked beforehand.
